The lawsuit was filed last week, alleging that 10-year-old Mykael Vasquez suffered from a second-degree and third-degree burn after a McDonald's franchise served hot chocolate that was "too hot for consumption," particularly for children. The lawsuit also states that the fast food restaurant chain did not adequately secure the lid of the hot chocolate cup before serving the beverage. The family claims that they're seeking compensation to cover the girl's medical bills and for pain and suffering associated with scarring from the hot chocolate spill.
Many personal injury attorneys are saying that this particular case resembles a 1994 lawsuit where a customer sued McDonald's after being burned by hot coffee at the restaurant chain. In that case, the plaintiff was awarded more than $2 million, however a judge later reduced this to an undisclosed amount of money.
